Introduction

Fretstep.com, which will also be represented by (“We”, "Our", "Fretstep", or “Us”), is a social networking community which allows individual Users (also represented by "You", "Your", Player(s), Trader(s), or "Member(s)") to play the game system, and also to promote themselves and or possessions by creating user profiles and other promotional content. Fretstep.com is hosted in the United States of America and is currently viewable but may not be fully accessible to every visitor to the site. Our vision is to provide a system in which members benefit from their own interactions. By accepting to sign up for membership of Fretstep.com, you are agreeing to the terms set forth in the Terms and Conditions and the Fretstep Privacy Policy, Game Rules and Regulations, Frequently Asked Questions, and Fees Schedule which are attachments to these terms. Fretstep may revise these terms at any time to update necessary information in order to better protect you and us.

Term

The membership with Fretstep shall be a non-exclusive agreement between you and us, and shall be upheld by each party according the these terms in this document. There is no expiration on membership with us and once activated, you receive the ability to perform all functions granted to all of our general users, unless otherwise restricted. We may restrict or refuse membership to you, with or without notice if we consider the restriction or refusal to be warranted.

Eligibility

In order to become a member of the Fretstep community:
a) You must be a real man or woman of at least 13 years of age. Computer programs or other forms of non humans are ineligible.
b) If you are under 18 years of age and ARE NOT a liberated minor, and you want to use some of our features that require 18 years of age, you will ONLY be eligible after your parent or guardian have read and accepted these terms.
c) If you ARE a liberated minor, you MUST declare such status to us by sending an email to our legal department (legal@fretstep.com) with a copy of the legal United States document declaring you liberated.
d) You must not present false information about your age in any form. Some features endorsed or offered by Fretstep may be set for only people of at least 18 years old, and in no manner should you abuse those privileges by presenting falsified information about your age to make yourself seem to be an age which is not true.
e) You must not seek membership to Fretstep to use our community for any purpose which will violate the law regardless of your or our jurisdiction. The eligibility regulations are strictly enforced, and you are agreeing that you will be responsible for any damages suffered by any party as a result of your violation of these rules and regulations. Violations of these terms may result in immediate termination of your membership with or without prior notice.
f) You are promising to follow all rules and regulations set forth in these Terms and Conditions and all attachments noted above.

Content

Ours: All non-advertising content presented on Fretstep.com by us (example: logos, slogans, images, video, audio, text, photos, files, and other forms of intellectual property posted by Fretstep) and the recording of all moves players make in the game play section belong solely to Fretstep.com. Any individual or entity which duplicates, replicates, redistributes, uses or otherwise manipulates any or all of our content material without written consent from Fretstep.com will be in violation of applicable United States intellectual property laws. Fretstep.com, its parent company and or our affiliates will seek and prosecute to the fullest extent of the law, any individual or entity which violates our proprietorship rights. Fretstep.com does not promote any type of content which represents: pornography, sexual solicitation, profanity, bigotry, racism, sexism, violence to others, libel, slander, spamming, viruses, harassment, nudity, abuse, piracy, unsolicited mail or text, copyright infringement, hatred, or activities that are in violation of applicable laws. You also agree NOT to use the Fretstep.com services in any way which may also violate the United States or international trade laws.

Yours: Content posted by you is in no way controlled by Fretstep.com. We do not own, nor claim to have proprietorship over any or all materials you upload, post or otherwise distribute to the Fretstep community. You are agreeing that you are the sole owner of all materials you post on Fretstep.com and that you grant us a non-exclusive international license to use your content in which we may: edit, delete from our site, advertise, publish, redistribute, and or reproduce in connection with the Fretstep services, and you will not receive at any time, royalties for the use of your content. You agree that the content you post does not promote any type of the content violation including: pornography, sexual solicitation, profanity, bigotry, racism, sexism, violence to others, libel, slander, spamming, viruses, harassment, nudity, abuse, piracy, unsolicited mail or text, copyright infringement, hatred, or activities that are in violation of applicable laws. You agree that you own or have a right to the content you post and that you are not violating personal property, intellectual property, copyright, patent, trademark, criminal or any other laws. You agree that you will be responsible for any or all damages suffered by any individual or entity as a result of your posting content on the our website. You will not post or upload any type of materials which may cause harm to the Fretstep community or its members in any form including hacking, stealing, or otherwise abusing the community.

Fees

The Fretstep membership provides users access to services both at no cost and also services we consider to require a small fee. We currently do not charge a fee for general membership registration to become a part of our community. Be advised that we reserve the right to charge a fee for any of our services, and may change our terms regarding fees at any time at our discretion with or without notice and you will be in violation of these terms for failure to pay fees due to Fretstep by you. A list of our current fees is demonstrated on our fee schedule.

Promotions

We offer promotional services for a variety of avenues including: companies, banners, interactive ad content, events, music, models, pictures, classifieds, autos, dating, jobs, general advertisements and other activities in which some of the services may require fees.

Member Conduct

We promote a friendly atmosphere in our community and you must not abuse your member privileges by attempting to or using our services in a way to inflict harm on others. You also agree not to attempt to or use our services in a way in which you may avoid paying applicable fees for such services.

Suspension and or Termination

Fretstep.com community membership is an option to you and you may terminate your membership at any time with or without notice for any or no reason. Fretstep may also at our discretion, terminate your membership with or without notice at any time. Fretstep.com at times may suspend your account with or without notice for a period of time if you violate the terms and conditions.

Privacy

Our privacy policy is an attachment to these terms and by choosing to become a member of our community, you are in full agreement with the terms.

Password

The ability to use Fretstep community requires you to create a password for your account access. The responsibility for protecting and securing your Fretstep.com password rests completely with you. Your password is encrypted in our databases and our employees do not have access to such information. You agree NOT to share or redistribute your password to another individual or entity, NOR to use our services with the password and other membership information of any person other than yourself. We will not be liable for any damages caused by your failure to properly secure your password from others or abide by the password restrictions.

Disputes

If you believe your property rights have been violated or you need to report a dispute for any type of Terms and Conditions violation, please be at liberty to report your dispute of the particular issue to the designated dispute section in our Help Center. Be advised that we will work meticulously and diligently with and for you, to resolve the matter in the most suitable and satisfactory manner permitted by law.

Indemnity

By signing up for membership, you agree to hold Fretstep, its parent company, affiliates, employees, partners, subsidiaries, officers, or any other business associates of Fretstep HARMLESS for any or all damages, liabilities, claims, or any other judgments arising from your use of our services causing breach or violation of the terms of this agreement or the law. You also agree to indemnify Fretstep and others in the occurrences of such damages as a result of your violation of these terms.

Governance

These terms are governed by the laws of the state of Georgia. Any litigation, arbitration, mediation, or other legal resolutions will be set in the governing state.

Conclusion

Fretstep.com will ensure that each user is treated lawfully, and we will thoroughly investigate all matters submitted to our complaint department. While we understand that not all issues may pertain to us directly, we will work with our users in the best way possible to assist in solving potential problems. We encourage all our members to keep us informed about ways to improve our site. We value the interest of all our members and we thrive to serve all regardless of classification.
